AUSTIN, Texas -- The Texas Supreme Court has reversed a $7.5 million verdict in a benzene case, finding that the testimony of plaintiff experts linking acute lymphoblastic leukemia to benzene exposure was conclusory and not supported by sufficient evidence. The City of San Antonio v. Pollock, et al., No. 04-1118 (Texas Sup. Ct.).
In the May 1 opinion, the high court additionally found that the petitioner in the instant proceedings, the City of San Antonio, was immune from the plaintiffs' property damage claims, as there was no evidence that the city intended to damage the property.
