LEXINGTON, Ky. -- Noting that the plaintiffs had until February 28 to serve a solvent defendant and failed to do so, a Kentucky federal court has dismissed the defendant without prejudice. Watkins, et al. v. Safety-Kleen Systems Inc., et al., No. 08-224 (E.D. Ky.).

In an March 30 order, the U.S. District Court for the Eastern District of Kentucky said that in late January, it gave the plaintiffs one month to serve Flamemaster Corp. with notice of the lawsuit, which contains allegations that exposure to chemicals and solvents caused brain damage.
