OMAHA, Neb. -- Nebraska defendants have filed a reply brief supporting their position that Nebraska courts have, in fact, adopted the sophisticated user doctrine and that it is proper for the instant court to employ it in the instant proceedings. Vondra v. Barton Solvents, et al., No. 07-85 (D. Neb.).
In the Feb. 27 filing in the U.S. District Court for the District of Nebraska, the defendants say that contrary to the plaintiffs' arguments, the sophisticated user doctrine is well established as a defense to negligence and strict liability failure to warn claims.
