DETROIT -- In a ruling that could impact thousands of other state court cases, a Michigan judge has found that testimony offered by R. Michael Kelly, M.D., in an asbestos case is inadmissible. Miles v. Sure Seal Products Co., et al., No. 04-434812-NP (Mich. 3rd Jud. Cir. Ct., Wayne Cty.).

During a Nov. 19 hearing, Judge Robert J. Colombo of the Third Judicial Circuit Court for Wayne County read his ruling from the bench, opining that Dr. Kelly's methodologies for interpreting spirometry results and diagnosing asbestos-related disease do not conform with the criteria established by the American Thoracic Society (ATS).
