Wash. Court of Appeals Reverses Summary Judgment for Union Carbide

TACOMA, Wash. -- A Washington appellate court has reversed an award of summary judgment to Union Carbide, finding that there was sufficient evidence supporting the plaintiffs' allegation that he was exposed to asbestos in two joint compound products. Taylor, et al. v. Union Carbide Corp., et al., No. 37317-3-II (Wash. Ct. App.).

In the Nov. 4 decision, Division Two of the Washington Court of Appeals found that a trial court erred when dismissing the asbestos claims against the defendant.

According to the opinion, David Roy Taylor's mesothelioma was caused by exposure to asbestos in Union Carbide's joint compound product. …
