Ohio Court of Appeals Finds Plaintiffs Satisfied Medical Criteria Requirements

CLEVELAND -- An Ohio appellate court has affirmed denial of a motion to dismiss filed by defendants who claimed that an asbestos plaintiff did not satisfy requirements of the state's medical criteria bill. Sinnott, et al. v. Aqua-Chem Inc., et al., No. 88062 (Ohio Ct. App., 8th Dist., Cuyahoga Cty.).

In the July 31 opinion, the Eighth District Court of Appeals for Cuyahoga County said that just because the plaintiff did not have a traditional doctor-patient relationship, he was still examined by a competent medical authority, thus fulfilling the parameters of the act.
