Ill. Court Affirms Dismissal of Claims Against ExxonMobil, Georgia-Pacific

MT. VERNON, Ill. -- An Illinois appellate court has affirmed an award of summary judgment, saying that ExxonMobil did not control the construction project at which the alleged asbestos exposure occurred to the extent that would require it to warn the decedent of potential dangers. Gregory, et al. v. Beazer East, et al., No. 1-06-3597 (Ill. Ct. App., 5th Div.).

The Fifth Appellate District of the Illinois Court of Appeals also affirmed the application of Indiana law to the claims, and a later decision by the trial court that the Indiana statute of repose barred claims asserted against Georgia-Pacific.
