Texas Appellate Court Says It Can't Review New Trial Order

BEAUMONT, Texas -- A Texas appellate court has denied a petition for writ of mandamus challenging a trial court's decision to order a new trial in an asbestos case, saying it lacks the authority to do so. In re: E.I. DuPont De Nemours and Co., No. 09-08-318-CV (Texas 9th Dist. Ct. App.).

In the July 24 opinion, the Ninth District Court of Appeals noted that while exceptions do exist to the precedent, the defendant failed to show that those exceptions are applicable in the instant proceedings.
