Court Affirms Dismissal, Says Plaintiffs Failed to Establish Origin of Dust

ANNAPOLIS, Md. -- The Maryland Court of Special Appeals has affirmed awards of summary judgment to three asbestos defendants in three cases, ruling that while testimony proffered by the plaintiff established that the decedents were in the vicinity of dust, it did not identify where this dust originated and whether it contained asbestos. Reiter, et al. v. ACandS Inc., et al., No. 670 (Md. Ct. Special App.).
In the May 6 opinion, the appellate court concluded that the testimony was not sufficient to comply with the state's requirements in proving substantial factor causation.
