Court Reverses Summary Judgment to Imo Industries in Asbestos Case

SEATTLE -- A Washington Court of Appeal has reversed an award of summary judgment to defendant Imo Industries, in light of recent rulings that a manufacturer of a product requiring asbestos-containing insulation could be held liable for failure to warn. Ingwersen v. IMO Industries Inc., et al., No. 59379-0-I (Wash. Ct. App.).
In the May 5 decision, the appellate court also found that with the evidence presented, one could conclude that the plaintiff was exposed to the asbestos-containing products.
