SAN FRANCISCO -- Judgment entered in favor of Metalclad Corp. has been reversed by a California appellate court, which determined that portions of declarations entered on behalf of the plaintiffs were improperly stricken. Sparks, et al. v. Metalclad Insulation Corp., No. A117838 (Calif. 1st Dist. Ct. App., Div. 5).
In the March 21 opinion, the First Appellate District of the California Court of Appeal opined that testimony from Charles Ay and Kenneth Cohen were wrongfully stricken and that with the testimony, there exists a question as to whether the plaintiff's lung cancer was caused by exposure to asbestos in Metalclad …
