Court Upholds Summary Judgment, Says Testimony Fails to Support Claims

PHILADELPHIA -- Testimony proffered by two of an asbestos plaintiff's former co-workers did not establish that the decedent was regularly exposed to products manufactured by three asbestos defendants, justifying an award of summary judgment, a Pennsylvania court has ruled. Iannucci v. Cleaver-Brooks Inc., et al., December Term, 2005 No. 1830; June Term, 2007 No. 3869 (Pa. 1st Jud. Dist. Ct. Comm. Pls., Philadelphia Cty.).

In the April order, the First Judicial District Court of Common Pleas for Philadelphia County affirmed summary judgment awards to Cleaver-Brooks Inc., Goulds Pumps Inc. and A.O. Smith Corp. after determining that the plaintiffs could not …
