La. Court Remands Asbestos Action, Says In-State Defendant Still Party in Action

NEW ORLEANS –– A Louisiana federal court has remanded an asbestos action, finding that the removing defendant had failed to prove that the plaintiffs had reached a settlement agreement with an in-state defendant. Landry, et al. v. Eagle Inc., et al., No. 12-1022 (E.D. La.).

In the June 19 opinion, the U.S. District Court for the Eastern District of Louisiana did acknowledge, however, that there were “lingering doubts” as to whether the claims were in fact settled or dismissed. However, “because the Court is required to strictly resolve any such doubts in favor of remand, Plaintiffs’ motion will be granted.” …
