Court Reverses Dismissal, Says Testimony Places Older Tile at Work Site

SEATTLE -- A Washington appellate court has reversed the dismissal of claims against a tile manufacturer, opining that when viewing the evidence in a light most favorable to the plaintiff, the claims were pled sufficiently. Butler, et al. v. Amtico International Inc., et al., No. 58552-5-I (Wash. Ct. App., Div. 1).

The First Division of the Washington Court of Appeal also found on Feb. 19 that the plaintiff had provided enough evidence that the asbestos-containing tile products were a substantial contributing factor in his development of mesothelioma.
