Appellate Court Affirms Trial Court's Determination of Settlement Offsets

SAN FRANCISCO -- An appellate court has upheld a jury verdict against Duro Dyne, rejecting several of the duct connector manufacturer's assignments of errors, including one that argued that the trial court should have adjusted the verdict to offset settlements that had not yet been paid. Garcia, et al. v. Duro Dyne Corp., No. A113027/A113369 (Calif. Ct. App., 1st Dist., Div. 1).
In the Oct. 16 ruling the California First District Court of Appeal found that when and if the defendants do pay the agreed settlement costs, Duro Dyne reserves the right to seek further offset credits.
