Calif. Court Remands Asbestos Action, Cites Ongoing Discovery

LOS ANGELES –– A California federal court has granted a motion to remand an asbestos action, finding that it could not rule out the possibility that the plaintiffs would be able to gather evidence against two California-based defendants. Couscouris, et al. v. Hatch Grinding Wheels Inc., et al., No. 12-4464 (C.D. Calif.).
In its June 14 opinion, the U.S. District Court for the Central District of California noted that the distinction in the instant case is that it is currently in the discovery stage, as opposed to the pleadings stage.
