Hamilton Loses 9th Circuit Appeal; Dismissal of Claims Stands

SAN FRANCISCO -- The U.S. Court of Appeals for the Ninth Circuit has rejected a wallboard and texturing manufacturer's appeal of the dismissal of several claims stemming from the company's contention that Union Carbide misrepresented and concealed safety concerns when selling asbestos-containing products. Hamilton Materials v. Union Carbide Corp., et al., No. 05-55976 (9th Cir.).
On May 31, the 9th Circuit affirmed the decision of the U.S. District Court for the Central District of California that found claims brought against Union Carbide for its asbestos fiber Calidria were time-barred.
