SAN FRANCISCO - A former pipefitter presented sufficient evidence to create a triable issue as to whether he was exposed to asbestos dust aboard naval vessels, an appellate court has ruled in reversing summary judgment for Metalclad Insulation Corp. Setterberg, et al. v. Metalclad Insulation Corp., No. A113997 (Calif. Ct. App., 1st Dist.).
On May 24, California's First Appellate District said the trial court erred in accepting Metalclad's argument that David Setterberg could not prove he had been exposed to the Unibestos that Metalclad had supplied to Mare Island Naval Shipyard in 1968.
