KANSAS CITY, Mo. -- The Missouri Court of Appeals has issued a writ of prohibition in an asbestos case, finding that because no co-employee liability exists, the circuit court does not have subject matter jurisdiction over the claims. State of Missouri, et al. v. The Honorable Stephen Nixon, et al., No. WD67518 (Mo. Ct. App., Western Dist.).
In the April 24 opinion, the court ordered the lower court to dismiss the claims without prejudice because they fall under the jurisdiction of Missouri Workers' Compensation Law.
