Pittsburgh Corning Bankruptcy Estate Retains Interest in Settlement

PITTSBURGH, Pa. - A settlement for $15,000 represents bankruptcy estate property when the check it was written on was dishonored at the time of transfer, a bankruptcy court judge has ruled. In re: Pittsburgh Corning Corp., No. 00-22876 (W.D. Pa. Bankr.).

Judge Judith K. Fitzgerald denied a motion to direct payment of settlement after she determined that transfers represented by a check occur on the date the check is honored, rather than the date the payee receives it.
