CHARLOTTE, N.C. - A federal judge has awarded summary judgment to two engineering and construction defendants, finding that the plaintiffs failed to allege with specificity that the companies' conduct resulted in their asbestos exposure. Agner, et al. v. Daniel International Corp., et al., No. 98-220 (W.D. N.C.).

Judge Lacy H. Thornburg of the U.S. District Court for the Western District of North Carolina said in a Jan. 5 decision that, at most, the plaintiffs have shown exposure to asbestos as a result of the conduct of an additional party, but not that of the moving defendants - Fluor Enterprises Inc. …
