LOS ANGELES -- A mesothelioma case that ended in a hung jury after a September trial has been dismissed after the court was informed that written settlement agreements had been obtained. Bercher v. Elliott Co., No. BC347728 (Calif. Super. Ct., Los Angeles Cty.).
The Dec. 11 notice of ruling filed in the Los Angeles County Superior Court noted that the court dismissed the case. Sources told HarrisMartin that after the jury in the Sept. trial was unable to reach a verdict, Judge Susan Bryant immediately scheduled a retrial. However, the parties settled before the second trial began, sources said.
