Texas Court Finds Verdict Unaffected by Erroneous Jury Instructions

FORT WORTH, Texas -- Despite finding that a jury was given improper instructions in an asbestos trial, a Texas appellate court has ultimately determined that the error did not result in improper judgment. Verret, et al. v. American Biltrite, et al., No. 2-04-244-CV (Texas 2nd Dist. Ct. App., Forth Worth).
In the Aug. 31 opinion, the 2nd District Court of Appeals for Forth Worth opined that a 'but for' causation instruction in what should have been a concurrent cause case.
