Texas Appeals Court Finds Statute of Limitations Ran Out for Plaintiff

AUSTIN, Texas - A Texas appeals court has affirmed a lower court's order awarding summary judgment to Brinkmann Investments, agreeing with the district court's finding that the statute of limitations had expired before the plaintiff filed his claim. King v. Brinkmann Investments Inc., et al. No. 03-05-00316-CV (Texas Ct. App., 3rd Dist.).

On Aug. 25, the Texas 3rd District Court of Appeals affirmed the Travis County District Court's order, finding that Michael R. King waited too long to file his asbestos-related injury claim against Brinkmann Investments Inc., Brinkman Roofing & Sheet Metal Co. and Anthony Delmonico.
