Court Denies Challenge to Chrysotile Order; Petition Filed in High Court

HOUSTON -- Defendants who recently failed to persuade an appellate court to reverse a Texas Asbestos MDL order allowing plaintiffs to proceed with claims linking chrysotile exposure to asbestos-related diseases have asked the Texas Supreme Court to reverse the order. In re: Garlock Sealing Technologies LLC and Georgia-Pacific Corp., No. 06-0881 (Texas Sup. Ct.).
In an Oct. 9 petition, Garlock Sealing Technologies and Georgia-Pacific Corp. said the district court's order, and the Texas 14th Court of Appeals affirmation of that order, 'throws open the evidentiary gates to any and all general causation evidence Plaintiffs wish to introduce at trial.'
