COLUMBUS, Ohio - An insurance carrier seeking coverage from its reinsurer for asbestos losses paid to Owens Corning Fiberglas (OCF) may not compel the reinsurer to produce certain documents because they are protected by the attorney-client privilege, a federal judge has ruled. Travelers Casualty and Surety Co. v. Excess Insurance Co. Ltd., No. 2:99-CV-389 (S.D. Ohio).
In a Nov. 8 decision, Judge Norah McCann King of the of the U.S. District Court for the Southern District of Ohio said the privilege precludes production of the documents because they were derived from discussions between reinsurers and their clients during a conference …
