Plaintiffs Oppose Writ, Claim Chrysotile Order Backed by Evidence

HOUSTON -- Plaintiffs involved in the Texas Asbestos MDL have opposed a writ of mandamus seeking relief from an admissibility-related order, arguing that the decision was backed by sufficient causal evidence linking chrysotile fibers in mesothelioma development. In re: Garlock Sealing Technologies and Georgia-Pacific Corp. No. 14-06-00467-CV (Texas Ct. App., 14th Dist.).
In an Aug. 7 response filed in the Fourteenth Court of Appeals, the plaintiffs additionally claim that the writ of mandamus is untimely, as it was filed nearly one year after the order denying the motion to strike evidence linking chrysotile fibers and mesothelioma was entered.
