Ind. Court Affirms Summary Judgment, Says Statute of Repose Applicable

INDIANAPOLIS -- The Indiana Court of Appeals has rejected a plaintiffs' interpretation of the state's statute of repose, opining that it would be 'illogical' for the court to consider a manufacturer defendant as a miner and seller of commercial asbestos. Briggs, et al. v. Griffin Wheel Corp., et al., No. 49A02-0508-CV-724 (Ind. Ct. App.).

In the Aug. 10 opinion, the appellate court affirmed an award of summary judgment to two asbestos defendants who contended the claims asserted against them were precluded by the 10-year statute of repose.
