Miss. High Court Affirms Ruling Enforcing Settlement Agreement

JACKSON, Miss. -- The Mississippi Supreme Court has rejected efforts by Illinois Central Railroad to void a settlement agreement, agreeing with a circuit court that information omitted by the plaintiffs did not help or hurt the asbestos defendant. Illinois Central Railroad Co. v. Acuff, et al., No. 2005-CA-00388-SCT (Miss. Sup. Ct.).
In the Aug. 3 opinion, the high court also opined that the defendant had not proved the omission of the information relating to involvement in other asbestos litigation was intentional.
