Judge Remands 107 Cases Removed by ACandS Following Armstrong Bankruptcy Filing

PHILADELPHIA - A judge in Pennsylvania who oversees the Asbestos MDL has granted a motion to remand more than 100 cases that ACandS, Inc. had removed to federal court following the Chapter 11 filing of Armstrong World Industries. Agren, et al. v. ACandS, Inc., No. 01-CV-1056 (E.D. Pa.).
By order issued April 19, U.S. District Judge Charles R. Weiner sent the cases back to the Philadelphia Court of Common Pleas, where some are scheduled for trial as early as this month. The decision, however, has been stayed pending rehearing.
