Court Upholds Defense Verdict, Finds Jury Selection Process Proper

TEXARKANA, Texas -- A Texas appellate court has upheld a defense verdict in a mesothelioma case, opining that the jury selection process did not wrongfully prejudice the plaintiff. Brooks, et al. v. Armco Inc., et al., No. 06-04-00111-CV (Texas 6th Dist. Ct. App.).
In a May 17 opinion, the Texas Sixth Appellate District Court determined that the 'harmless error rule' applied to a trial court's decision to grant the defendant an extra peremptory challenge.
