La. Court Affirms Dismissal, Says Texas Suit Doesn't Stop Prescription

BATON ROUGE, La. -- A Louisiana Court of Appeals has affirmed the dismissal of several asbestos defendants, finding that because a wrongful death action was filed more than one year after the plaintiff's death, the claims were barred by the statute of limitations. Adams, et al. v. Asbestos Corp., et al., No. 41, 028-CA (La. 2nd Cir. Ct. App.).
In the May 17 opinion, the Second Appellate Circuit of the Louisiana Court of Appeals also refused to allow a Texas action to serve as an interruption to the state's prescription period.
