JACKSON, Miss. -- The Mississippi Supreme Court has affirmed an order enforcing a settlement agreement, saying the plaintiffs' failure to mention involvement in related cases was inadvertent and not prejudicial to defendant Illinois Central Railroad Co. Illinois Central Railroad Co. v. McDaniel, et al., No. 2005-CA-00389-SCT (Miss. Sup. Ct.).
In a June 15 decision, the state's high court also affirmed the denial of an asbestos plaintiff from entering into the settlement agreement, finding no evidence that the plaintiff filed the claim within the three-year statute of limitations.
