HOUSTON -- A Texas appellate court has affirmed an award of summary judgment to Crown Cork & Seal, finding that the trial court did not err when retroactively applying a statute limiting liability of successor companies. Robinson, et al. v. Crown Cork & Seal Inc., No. 14-04-00658-CV (Texas 14th Ct. App.).
In the May 4 decision, the Texas 14th Court of Appeals said the Texas Legislature exercised 'valid police power' when making the statute retroactive.
