TRENTON, N.J. - Dissatisfied with the trial court's equal allocation of responsibility against several employers for an employee's pulmonary asbestosis, a New Jersey appeals court has remanded the case to the lower court a second time, this time ordering the court to assign responsibility proportionally to three of the defendants. Levas v. Midway Sheet Metal, et al., No. A-3577-98T5 (N.J. Super. Ct., App. Div.).
"Notions of equity . . . were not part of what we instructed the judge to consider," the court wrote in its Feb. 23 opinion.
