Texas MDL Judge Clarifies Malignant Medical Report Requirements




HOUSTON - The judge overseeing the Texas Asbestos MDL has issued directives to the involved parties in hopes of clarifying what is specifically required of medical reports filed in asbestos cases that involve malignant diseases. In Re: Asbestos Litigation, 2004-03964 (Texas Dist. Ct., Harris Cty.).

The April 21 hearing was presided over by Judge Mark Davidson of the District Court for Harris County and addressed certain defense objections to plaintiffs' medical reports under TCPRC § 90.003, the asbestos-related Texas statute requiring a medical report by a board-certified physician.
