Texas High Court Grants Review in Asbestos Causation Dispute

AUSTIN, Texas -- The Texas Supreme Court has granted a petition to review a $150,000 asbestos verdict, which asbestos defendant Borg-Warner Corp. contends is an example of inconsistent causation standards established by Texas courts. Borg-Warner Corp. v. Arturo Flores, No. 05-0189 (Texas Sup. Ct.).
The high court granted review on April 21 but did not set a date for oral arguments.
Plaintiff Arturo Flores was awarded more than $150,000 for injuries arising from exposure to asbestos-containing brake pads manufactured by defendant Borg-Warner Corp. A jury found Borg-Warner liable for negligence and strict liability, and also determined that the company acted …
