Ohio Court Vacates $6.4 Million Verdict, Remands for New Trial

CLEVELAND -- An Ohio appellate court has vacated a $6.4 million verdict and remanded an asbestos case for a new trial, saying that the defendant was prejudiced by the trial court's allowance of a video demonstrating dust generation. Blandford v. A-Best Products Co., et al., No. 85710, 86214 (Ohio Ct. App., 8th Dist.).

In the March 23 decision, the Eighth District of the Ohio Court of Appeals also opined that the trial court erred when allowing the testimony of William Longo, Ph.D., who was originally on the list of witnesses but was removed just prior to trial.
