California Arguments to Proceed Over Market Share General Order for Friction Defendants

SAN FRANCISCO - Judges in California have agreed to hear arguments over whether the court should adopt a general order clarifying the plaintiffs' burden under market share theory of recovery against friction defendants. In Re: Complex Asbestos Litigation, No. 828684 (Calif. Super. Ct., San Francisco Cty.).

In an order issued March 9, the court said it would begin entertaining motions on the market share general order and an order that would standardize sets of interrogatories for friction defendants named in asbestos suits.

The deadline for the filing of briefs in support of the general order was set for 30 days …
