Utah Court Refuses to Apply Lohrmann Standard in Mesothelioma Case

SALT LAKE CITY -- A Utah court has declined to implement the 'frequency, regularity, proximity' standard in a mesothelioma lawsuit. Sortor, et al. v. Asbestos Defendants, et al., No. 040909899 (Utah 3rd Jud. Dist. Ct., Salt Lake Cty.).

On March 13, Judge Glenn K. Iwasaki of the Third Judicial District Court for Salt Lake City opined that each asbestos case was unique in nature and that a plaintiff did not need to incorporate a regular and frequent proximity test in order to establish causation.
