MDL Court Says Expert's Work Not Protected by HIPAA

PHILADELPHIA -- The court overseeing the Asbestos Products Liability Litigation MDL has entered an order confirming that the documents and materials of several experts and screening companies who have testified in asbestos litigation are not protected within the scope of the Health Insurance Portability and Accountability Act. In re: Asbestos Products Liability Litigation, MDL No. 875 (E.D. Pa.).
Judge James T. Giles of the U.S. District Court for the Eastern District of Pennsylvania entered three separate orders in February pertaining to the documents and materials of Dr. Robert J. Mezey, Dr. James P. Krainson, Innervisions Inc. and Innervisions Medical Services.
