N.C. Court of Appeals Upholds $7.5 Million Verdict

RALEIGH, N.C. -- A Court of Appeals has upheld an award of $7.5 million in a FELA mesothelioma case, rejecting the defendant's assertion that the trial court allowed improper cross-examination of its witnesses. Williams, et al. v. CSX Transportation, No. COA05-488 (N.C. Ct. App.).
The North Carolina Court of Appeals affirmed the award on March 7.
Plaintiff Raymond Williams claimed in his Federal Employer's Liability Act (FELA) lawsuit that CSX Transportation failed to warn him about the dangers of asbestos, which ultimately caused his mesothelioma. Williams claimed he worked for CSX and its predecessor railroad from 1962 until 1999.
