AUSTIN, Texas -- A Texas Appellate Court has denied a writ seeking relief from a trial court order remanding a case to the court where it was originally filed. In Re: Fluor Enterprises Inc., No. 03-06-00113-CV (Texas Ct. App., 3rd Dist.).
The Texas Third District Court of Appeals ruled on Feb. 27 that the judge overseeing the state's asbestos multi-district litigation did not err when remanding the claims that were transferred to him four days before they were set for trial.
