Court Affirms Verdict Linking Injuries to Asbestos-Containing Welding Rods

NEW YORK -- A New York Appellate Court has affirmed an award of $6 million to two welders who claimed their injuries were caused by exposure to asbestos-containing welding rods. In re: New York City Asbestos Litigation, Nos. 120146/01, 105031/02 (N.Y. Sup. Ct., App. Div., 1st Dept.).
The Dec. 29 decision by the First Department of the Appellate Division of the New York Supreme Court rejected a defense appeal of the verdict, finding that the dispute between the parties arose over causation, not over novel scientific techniques, therefore rendering a proposed admissibility hearing moot.
