Louisiana Supreme Court Remands Medical Monitoring Suit for Further Findings

NEW ORLEANS - The Louisiana Supreme Court has remanded a medical monitoring case to the district court, finding premature an appeals court ruling that the retroactive application of the state's Act 989 was unconstitutional. Crooks, et al. v. Metropolitan Life Insurance Co., et al., No. 01-0466 (La. Sup. Ct.).
In its May 25 decision, the state high court called for a new hearing on the original defense motions for summary judgment, at which time plaintiffs would be able to submit evidence demonstrating that their cause of action occurred prior to the enactment of Act 989.
