ROCHESTER, N.Y. -- A New York Appellate Court on Sept. 30 reversed the dismissal of a cross-complaint against DuPont, ruling that the cross-complaint was based on an underlying claim that accrued before the party filing the cross-complaint dissolved. Tedesco, et al. v. A.P. Green, et al., No. 05-00635 (N.Y. Sup Ct., App. Div., 4th Jud. Dept.).
Plaintiff Lena Tedesco commenced the asbestos lawsuit on behalf of her husband, claiming that he was exposed to asbestos-containing products supplied to his employer, DuPont by Insulation Distributors.
