NEW YORK -- A New York Appellate court has reversed a decision granting summary judgment to Goodyear in an asbestos case. Klopsis v. A.O. Smith Water Prods Co., No. 06540 (N.Y. App. Div., 1st Dept.).
In the Aug. 25 decision, the 1st Department of the New York Appellate Division opined that the court erred in exclusively relying on a deposition that the court found inadmissible.
In August 2004, Judge Helen E. Freedman denied Goodyear's motion for summary judgment, but subsequently granted a motion to reargue made by the asbestos defendant. On reconsideration, the court reversed the denial of summary …
