CHEYENNE, Wyo. -- Wyoming's highest court has affirmed the denial of compensation to a man alleging asbestos exposure who filed three separate injury reports, but never a claim for benefits. Popick v. State of Wyoming, et al., No. 05-3 (Wyo. Sup. Ct.).
In the Sept. 7 decision, the Wyoming Supreme Court also ruled that the court lacked subject matter jurisdiction.
Plaintiff Gregory A. Popick claims his work at numerous jobs exposed him to asbestos, including three jobs in Wyoming. Popick filed three separate injury reports with the Wyoming Workers' Safety and Compensation Division. The Division denied Popick's claims, stating that …
