Court Rules Plaintiff Put on Notice with Family Member's Asbestos-Related Illnesses




CHICAGO -- An appellate court has affirmed summary judgment awarded on statute of limitations grounds, opining that the asbestos-related diagnoses of the plaintiff's family members put him on notice of his asbestos-related injury. Healy v. Owens-Illinois, et al., No. 1-03-3054 (Ill. App. Ct., 1st Dist.).

The First District of the Illinois Appellate Court on July 15 affirmed an award of summary judgment to defendants after finding that the circuit court correctly ruled that plaintiff Francis J. Healy's claims were barred by the two-year statute of limitations.
