Liberty Mutual Seeks Declaration that Aggregate Limits Exhausted

ST. LOUIS -- Liberty Mutual has filed a declaratory judgment action, claiming that insured asbestos defendant Flexo/Stovey has exhausted its aggregate limits. Liberty Mutual Fire Insurance v. Flexo Supply Co., et al., No. n/a (E.D. Mo.).

The June 1 complaint filed in the U.S. District Court for the Eastern District of Missouri asserts that Flexo/Stovey did not manufacture asbestos-containing products, and therefore cannot use non-products operation coverage.

In seeking a declaratory judgment, Liberty Mutual claims that the aggregate limits pertaining to bodily injury issued to Flexo/Stovey have been exhausted, and consequently it has no further duty to defend or indemnify …
